1. Agreement to Terms

By accessing or using PriceRadar ("Service"), operated by Mahalo Mochi LLC ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree with any of these terms, you may not use the Service.

2. Service Description

PriceRadar is a price monitoring service that allows users to track competitors' pricing information. The Service includes:

• Automated price monitoring and tracking of competitor pricing pages
• AI-powered price extraction and analysis
• Historical price data and trend visualization
• Price change alerts (Pro and Business plans)

3. User Accounts

3.1 Account Creation

To use PriceRadar, you must:

• Create an account with a valid email address
• Verify your email address
• Maintain the security of your account credentials
• Be at least 18 years of age
• Notify us immediately of any unauthorized access

3.2 Subscription Plans

PriceRadar offers the following plans:

• Free: Up to 5 tracked URLs, daily scanning
• Pro ($2/month): Up to 20 tracked URLs, price change alerts, 12-month trend charts, instant price history backfill
• Business ($10/month): Up to 100 tracked URLs, 12-month trend charts, instant price history backfill, priority support

4. Payments and Billing

Paid subscriptions are billed monthly through Stripe. By subscribing to a paid plan, you agree to:

• Provide accurate billing information
• Authorize recurring monthly charges until you cancel
• Cancellation takes effect at the end of the current billing period

We reserve the right to change pricing with 30 days' notice. Refunds are handled on a case-by-case basis.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Submit URLs that you do not have a legitimate business reason to monitor
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service
• Automate access to the Service beyond normal use without permission
• Resell or redistribute data obtained through the Service

6. Data and Content

By using PriceRadar, you acknowledge:

• You are responsible for the URLs you submit for monitoring
• Pricing data is extracted from publicly available web pages
• We do not guarantee the accuracy or completeness of extracted pricing data
• We may anonymize and aggregate data for improving the Service

7. Service Availability

We strive to maintain reliable service but reserve the right to:

• Modify or discontinue any feature with reasonable notice
• Perform maintenance that may temporarily affect availability
• Set rate limits on API usage and scanning frequency
• Adjust tracked URL limits per plan

8. Intellectual Property

All content, features, and functionality of the Service are owned by Mahalo Mochi LLC and are protected by applicable intellectual property laws. You retain ownership of any data you submit to the Service.

9. Termination

We may terminate or suspend your account:

• For violations of these Terms
• For abusive or fraudulent activity
• At our sole discretion with reasonable notice

You may delete your account at any time through the Settings page. Upon termination, your data will be deleted within 30 days.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee:

• Continuous, uninterrupted access to the Service
• Accuracy or completeness of pricing data
• That the Service will meet your specific requirements

11. Limitation of Liability

To the fullest extent permitted by law, Mahalo Mochi LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Governing Law

These Terms shall be governed by the laws of the State of Hawaii, without regard to conflict of law principles.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
